The following list of conditions were presented:
a. The total enrollment of the school the student wishes to attend shall not exceed program capacity as defined by the facility having sufficient classrooms for total enrollment and still providing a separate classroom for art and music. b. The class size is at or below guidelines of bargained agreements or board policy for the grade level of the child for whom the variance is requested. c. The parent or guardian provides a written request for a boundary variance to the principal of the receiving school on or before February 1st of the school year before the boundary variance is to be effective. The decision to grant the boundary variance request will be made before the end of the school term. d. The parent agrees to provide transportation for the child. e. The principal of the receiving school approves the request for the boundary variance. f. Once approved, the boundary variance will remain in effect as long as the parent maintains continuous enrollment of the child in the alternate attendance boundary school. g. Boundary variances will not be granted to parents for the all day kindergarten.
The Batavia school board voted to allow people to opt out of or opt into the MI program at the new West side school by requesting a boundary variance. They discussed the boundary variance just be a hand written letter from the parents to the principal of the school to which attendance is being requested. Later they discussed creating a form of some sorts to fill out but didn't go into any details.
Those wishing to opt out of the MI program must choose the same school where they are at now as the boundary variance choice, ie. Gustafson or Storm.
Those residents who are not in the West side boundary must request a boundary variance to be able to attend the MI program. This includes families who are currently at McWayne and are not in the West side school boundary.

Once assigned a school either by being granted a boundary variance or by having a boundary variance denied your child will have to continue at the assigned school all the way through 5th grade. That is a good thing if you do get a boundary variance granted but if you get denied you are stuck with no appeal. The principal's decision is final according to what the board said.
Ed Cave recommended that bussing not be provided for anyone who is granted a boundary variance. Several board members objected to this and decided to push a decision on this out to a later date. This is item 'd' in the list of conditions to be met.
